Edudzi Tamakloe, Director of Legal Affairs for the opposition National Democratic Congress (NDC), has expressed support for the recent legal move by suspended Chief Justice Gertrude Torkornoo, describing her injunction application to the Supreme Court as “quite refreshing.”
Justice Torkornoo, who was suspended by President John Mahama under Article 146 of the Constitution following a petition for her removal, is seeking to prevent Justices Gabriel Scott Pwamang and Samuel Asiedu from participating in the investigative proceedings. This follows claims that the two justices allegedly held private meetings with a lawyer linked to the case.
Former Attorney-General Godfred Yeboah Dame is representing the suspended Chief Justice in filing the application.
Speaking in an interview, Tamakloe described the legal action as “interesting,” particularly given the nature of the reliefs being sought and the attempt to halt the work of the committee via an injunction.
“This application by Her Ladyship to restrain the committee from fulfilling its constitutional duties is indeed intriguing, especially in light of the reliefs she’s requesting,” Tamakloe said.
He emphasized that the situation highlights the importance of procedural fairness and due process. Tamakloe also noted the symbolic weight of the suspended Chief Justice now having to rely on the justice system she once presided over.
“I welcome the fact that the suspended Chief Justice will now experience firsthand how the justice system operates for ordinary citizens. Just like anyone else, she now stands to benefit from the very system she helped shape,” he remarked.
Tamakloe concluded with optimism, saying, “I hope she is given every right and opportunity entitled to her under the Constitution. It’s a refreshing development.”
